One Michigan police officer is apparently lingering in a state of ignorance when it comes to how to deal with HIV patients.

Recently, Officer David Lacey harassed a Dearborn woman (passenger) after pulling the driver over for a minor traffic infraction. The scene eventually progressed into a shakedown over marijuana. However, during the search, Lacey found the woman’s HIV medicine and completely panicked. He told her she should have revealed that she was HIV positive before he started digging through her things.

Lacey was concerned that could contract HIV if he touched any object the woman touched. He also seemed a bit frightened by the possibility of getting poked by one of the woman’s earrings. As it stands, the only way for HIV to be passed from one person to another is through sexual contact, the sharing of needles, mother to infant, and the use of tainted blood.

Furthermore, HIV patients are not required by Michigan law to reveal their condition to police officers. The law states that “it is a felony for an HIV-infected individual, who knows he/she is infected, to engage in sexual penetration without first informing the other person of the HIV infection.” There is nothing written that suggests a person with HIV must divulge their status every time a cop stops them and wants to search for weed.
