Michigan law enforcement claims it is not enough to bust motorists for texting and driving, which is why they have launched a campaign aimed at harassing citizens engaged in any form of “distracted driving,” from eating to changing the radio station.

While it is illegal to text and drive in Michigan, it is not against the law to stuff your face with fast food or play with the radio dial on the roadways. However, Michigan police are supposedly cracking down on this type of behavior because it may save lives, even though we all know it is just another clever excuse to initiate roadside shakedowns.

So, if eating a cheeseburger while driving is not against the law, how can authorities ticket a driver for this offense?

The answer is they can’t, but they can use the traffic stop as a reason to search for illegal contraband, such as drugs, or to determine if a person is driving impaired. It is really just a scam campaign aimed at busting people for larger offenses.

If you happen to get pulled over because a police officer claims he witnessed you eating and driving, politely show him or her your driver’s license and registration, but do not answer any further questions and do not consent to a vehicle search. Simply ask the officer, "Am I being detained?" and let them know "I do not consent to searches."
